ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, forbearing the respondents or his men, agent or any other person acting through them allowing from laying roads in respect of petitioner land in Patta No. 8962 in respect of extent of 65 cents comprised in Old Survey 400/1B and New Survey No.400/1B1B, situate at Varadharajapuram Village, Kundrathur Taluk, Kancheepuram District without due process of law.

2. The learned counsel appearing for the petitioner would submit that though this writ petition was filed, the road was laid in his patta land.

3. The learned Government Advocate appearing for the respondents would fairly submit that the road was laid in the petitioner's land and the same has to be removed therefore, if any direction is issued by this Court, the same will be complied with.

4. Heard the learned counsel appearing for the petitioner as well as the respondents.

5. In the present case, the petitioner filed this writ petition forbearing the respondents from laying road in his patta land. Though this writ petition was filed, the respondents laid road in the petitioner's patta land. Therefore, the said

road is required to be removed, since the same was laid in the patta land of the petitioner.

6. In view of the same, the 2nd respondent is directed to remove the road, which was laid in the petitioner's patta land within a period of eight weeks from the date of receipt of a copy of this order.
