Common Prayer:- Writ petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to deposit the award amount to the credit of LAOP No.12 of 2002 (WP No.10317 of 2020) LAOP No.15/2002 order dated 05.02.2010 by considering the representation dated 20.03.2018 as per the decree and judgement dated 28.11.2019 and 05.12.2019 respectively in A.S.No.986/2019 and 912 /2019 on the file of this Court.

COMMON ORDER Both the writ petitions are filed for the issue of writ of Mandamus directing the respondents to deposit the award amount as per the Judgement and decree in AS No.986 of 2019 dated 05.12.2019.

Heard the learned counsel for the petitioners and Mr.Rajadurai Raj, learned Special Government Pleader for the respondents.

The learned Additional Government Pleader has circulated a letter sent by the Revenue Divisional Officer, Thiruvannamalai to the District Collector, Thiruvannamali, wherein, the entire particulars with regard to the enhanced compensation payable to the respective parties has been enlisted and in sofaras the writ petitioner in WP No.10357 of 2020 is concerned, the enhanced compensation amount payable has been determined as 3,10,17,961/-. The determination of the amount for each of the claimants has been separately calculated in the working sheet annexed along with the letter.

The learned Additional Government Pleader appearing on behalf of the respondents submitted that there is a huge outflow of nearly 21 crores that has to be paid towards enhanced compensation. The learned counsel further submitted that the proposal has already been sent to the Government. The learned counsel therefore submitted that it will take some more time for the respondents to disburse the compensation amount to the petitioners.

Taking into consideration the facts and circumstances of the case and also of the fact that the proposal is pending before the Government, there shall be a direction to the respondents to pay the enhanced compensation amount to the petitioners, within a period of four months from the date of receipt of copy of this order.

These writ petitions are disposed of with the above directions. No costs.
