Heard the learned counsel for the petitioner. 2.

This Court by order dated 24.08.2023 in W.P.No.1241 of 2017 has passed the following orders:

"1.

The petitioner management is directed to deposit a sum of Rs.50,000/- before the first respondent within a period of two weeks from the date of receipt of a copy of this order.

2.

Upon receipt of which, the first respondent shall disburse the amount to the second respondent; and 3.

Further this Court sets aside the impugned award and remands the matter back to the Labour Court for fresh consideration and the same shall consider and pass orders as expeditiously as possible, after providing opportunity to the petitioner as well as the second respondent, on merits and in accordance with law." 3.

It is submitted that the petitioner has received a copy of the order dated 24.08.2023 on 11.12.2023 and subsequently, he has taken demand draft for Rs.50,000/- and deposited as directed by this Court and when the petitioner approached the first respondent Labour Court, they declined to receive on the ground that the time fixed by this Court to deposit has already been expired. https://www.mhc.tn.gov.in/judis

vca The petitioner then realised that copy application was not filed by the previous counsel on times, thereby delay occurred in compliance. 4.

It is further submitted by the learned counsel for the petitioner that the demand draft is ready for deposit and the delay in complying with the orders are inadvertent, non intentional and sought for extension of time. The petitioner has also filed photo copy of the demand draft to demonstrate that the demand draft is ready.

Considering the circumstances explained by the learned counsel for the petitioner, the order dated 24.08.2023 in W.P.No.1241 of 2017 to deposit an amount of Rs.50,000/- is hereby extended until 26.04.2024 and in other terms the conditions mentioned in order dated 24.08.2023 remains unaltered. 22.04.2024 vca Issue today W.M.P.No.11924 of 2024 https://www.mhc.tn.gov.in/judis
