ORDER

This criminal original petition has been filed against the docket order in M.C.No.617 of 2010 pending on the file of the Principal Family Court, Coimbatore.

2. Heard the learned counsel appearing for the petitioner.

3. It is seen that Shanmugasundaram (respondent herein) has filed HMOP No.617 of 2010 against Sudha (petitioner herein) for divorce before the Learned Principal Family Court and that, he approached this Court in CRP.(PD).No.1854 of 2015 for a direction to the learned Principal Family Court to dispose of HMOP No.617 of 2010 expeditiously within a time frame. This Court, by an order dated 28.04.2015 in CRP.(PD).No.1854 of 2015, has directed the learned Principal Family Court, Coimbatore, to dispose of HMOP No.617 of 2010 within a period of three months from the date of receipt of that order.

4. It is further seen that Sudha has also preferred M.C.No.17 of 2014 under Section 125 Cr.P.C against Shanmugasundaram and this case is also pending before the learned Principal Family Court. Since both matrimonial cases are pending before the same Court, in the interest of justice, the learned Principal Family Court, Coimbatore is directed to take up M.C.No.17 of 2014 simultaneously along with HMOP No.617 of 2010 and dispose of the same within a period of three months from the date of receipt of a copy of this order.

In view of the above observation and direction, the criminal original petition is closed.
