ORDER

This Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, seeking an order to direct the respondent police to take appropriate action on the complaint, dated 25.07.2015 lodged by the petitioner.

2. Heard both sides.

3. It is averred in the petition that the petitioner gave a complaint on 25.07.2015 before the respondent police alleging that third respondent, Yamuna Thamaraiselvi, squatted upon the property of the petitioner and the police has not initiated any action. Therefore, the present Criminal Original Petition has been filed.

4. The third respondent, party-in-person contends that she got three children through A.S.Viswanathan and denied the allegations made in the petition.

5. The learned Government Advocate contends that the complaint has been treated as petition (CSR No.158/2015) and enquiry has not yet been completed.

6. Though the matter was referred to Mediation Centre, the parties could not arrive at any settlement.

7. In the above circumstances, the 2nd respondent police is directed to go through the complaint of the petitioner, dated 25.07.2015 and if any cognizable offence is made out, further directed to register the case and proceed as per law. With the above direction, this Criminal Original Petition is disposed of.
