[ RESPONDENTS ] Writ petition is filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus to direct the 1st Respondent to consider the recommendations made by the 3rd Respondent dated 10.12.2014 bearing Na.Ka.No. 2402/2013/B1 and the recommendation of the 3rd Respondent dated 25.5.2015 bearing Na.Ka.No. 2402/2013/B1 and consequently place the petitioner in appropriate place by taking into account of his date of joining in the post of Village Panchayat Assistant / Panchayat Secretary as 20.01.1994 which is the date recorded in the Service Register of the Petitioner and promote him to the post of Junior Assistant from the date when his immediate junior was promoted.

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.According to the petitioner, he initially joined as Cholera Mazdoor on 01.04.1989 and thereafter he became Village Panchayat Assistant on 20.01.1994. However, mistakenly his date of joining as Village Panchayat Assistant was taken as 20.30.1997, and hence, he was not promoted to the post of Junior Assistant. 3.In this regard, the third respondent recommended the case of the petitioner by proceedings dated 10.12.2014 & 25.5.2015, for promoting the petitioner as Junior Assistant, by taking note of his date of joining as Village Panchayat Assistant as 20.01.1994. The grievance of the petitioner is that so far no order is passed by the first respondent, though he submitted a representation dated 16.5.2015.

4.In these circumstances, the first respondent is directed to consider the representation submitted by the petitioner dated 16.05.2015, in the light of the recommendations of the third respondent referred to above and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
