C.M.P.No.27123 of 2023 in C.M.A.Sr.No.49660 of 2022 N.ANAND VENKATESH , J Notice is dispensed with insofar as the respondents 1, 3 and 4 are concerned, since they are set ex-parte before the Tribunal.

Mr.R.V.Sivaraj, learned counsel takes notice on behalf of the 2nd respondent.

2.This Civil Miscellaneous petition has been filed seeking to condone the delay of 1013 days in filing the Civil Miscellaneous Appeal.

3.Heard the learned counsel for the Appellant and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 1013 days is condoned.

5.Registry is directed to number the main Civil miscellaneous appeal and list the same for admission. Registry is directed to print the name of R.V.Sivaraj, learned counsel for the 2nd respondent at the time of admission.

6.It is made clear that for the period of delay of 1013 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
