ORDER

The petitioner has come forward with this petition seeking for a direction, directing the respondents police to register a case based on the petitioner's complaint dated 06.10.2015, in C.No.3188 of 2015 and investigate the same.

2. The learned counsel for the petitioner submitted that the petitioner has given a complaint to the first respondent police on various dates, but, however, the respondents police had not taken any steps to enquire the matter and to register a case and hence, the petitioner has come forward with this petition for the above stated relief.

3. Resisting the same, the learned Government Advocate (Crl.Side), would submit that based on the complaint given by the petitioner dated 06.10.2015, the petitioner was called upon https://hcservices.ecourts.gov.in/hcservices/

for enquiry, but, she did not co-operate with the respondents police and thereafter, the same has been closed.

4. Considering the rival submissions made by the learned counsel on either side, the petitioner is directed to co-operate for enquiry and similarly, the second respondent police is directed to re-open the case and expedite the enquiry and follow the dictum laid down in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC) and register a case, if any cognizable offence is made out.

5. With the above directions, this Criminal Original Petition is closed.
