Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the conditions of appearing before the respondent police every day at 10.30 am imposed by this Honble Court in order dated 05.05.2021, in Crl.M.P.No.5653/2021 in Crl.A.No.169/2021. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.UDHAYASHANKAR, Advocate for the petitioner and of MR.S.SUGENDRAN, Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- Learned counsel for the petitioner/appellant would submit that the petitioner had filed an Application for suspension of sentence in Crl.M.P.No.5653 of 2021 and this court, by order dated 5.5.2001, granted suspension of sentence and imposed a condition that the petitioner shall report before the respondent police daily at 10.30 am until further orders.
2. The learned counsel for the petitioner would further submit that after coming out of bail, the petitioner has been complying with the condition by appearing before the respondent everyday at 10.30 am. He would also submit that because of the condition, the petitioner is unable to attend his day to day works and therefore, the present petition has been filed seeking relaxation of the condition imposed.
3. Learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioner has been regularly complying with the condition.
4. Taking into consideration the fact that the petitioner has been regularly complying with the condition, this court is inclined to modify the condition already imposed. Accordingly, the petitioner shall appear before the Trial Court viz., IV Additional District and Sessions Judge, Thiruvallur at Ponneri on the first working day of every English Calendar month at 10.30 am until further orders. The petition is ordered accordingly.
