PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a writ or order or orders or direction particularly in the nature of Writ of Mandamus, directing the respondents to pay the family pension to the petitioner for the death of her huband namely Narayanasamy, who working as Appraiser in the 3rd respondent bank and died on 08.06.2004 by considering the representation of the petitioner dated 16.07.2018 along with arrears with accrued interest at the rate of 12% per annum.

The claim of the writ petitioner is to pay family pension and other consequently monetary benefits. The learned counsel
for the writ petitioner states that after the demise of her husband who was an employee of the respondent bank, she made a representation to sought the family pension and other monetary benefits. However, no action was taken by the respondent bank and the writ petitioner is constrained to move the present writ petition.
2. The learned counsel appearing on behalf of the respondent bank, based on the written instruction provided to him on 28.09.2018, states that there was a delay on the part of the writ petitioner in submitting the legal heir certificate and the said legal heir certificate was now submitted on 11.07.2018. Accordingly, the respondents have forwarded the claim of the writ petitioner for grant of family pension to the Competent Authorities. The said proposal for sanctioning the family pension is now pending with the respondent.
3. Under these circumstances, the respondents are directed to consider the representation submitted by the writ petitioner for grant of family pension and other consequential benefits within a period of 12 weeks from the date of receipt of a copy of this order.
