PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus to direct the 2nd respondent herein to consider the petitioner's representation, dated 01.06.2015.

ORDER

With the consent of the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3, the writ petition is taken up for disposal at the admission stage itself.

2. The petitioner claims that he is the owner of the land in Survey No.152/1B1, Kawal Bazaar, Chennai to an extent of 11 cents on purchasing the same by means of a registered sale deed dated 13.11.1990 bearing document No.4611/1990 registered on the file of the Sub-Registrar, Pammal. The petitioner for the purpose of disposing of the property applied for encumbrance certificate and came to know that T.P.Ramamoorthy, the 4th respondent herein, fabricated the documents purported to be sale deeds dated 22.3.2010 bearing document Nos.1173, 1174, 1218 and 1219 of 2010 and in this regard he has submitted a representation dated 1.6.2015 to the respondents 1 to 3 praying for cancellation of the forged sale deeds. Since no response is forthcoming from the respondents, the petitioner has come forward with the present writ petition.

3. Heard the learned counsel appearing for the petitioner and Ms.P.Rajalakshmi, learned Government Advocate who accepts notice for respondents 1 to 3.

4. This Court, in the facts and circumstances of the case, without going into the merits of the claim projected by the petitioner, directs the 2nd respondent to consider and pass orders on the representation of the petitioner dated 1.6.2015 on merits and in accordance with law within a period of ten weeks from the date of receipt of copy of this order and communicate the decision taken, to the petitioner.
