ORDER

The present writ petition has been filed with a prayer for Mandamus to to direct the respondent to dispose the pending appeal in Na.Ka.No.15070/2017/E1 on the file of the respondent within stipulated time. 1/4

The learned counsel appearing on behalf of the petitioner would submit that the petitioner was served with Charge Memorandum on 04.04.2018 and thereafter, after conducting Domestic Enquiry, the Enquiry Officer has submitted a Report. On the basis of Enquiry Report, the Disciplinary Authority has passed an order of punishment of "Censure" on 25.04.2024 and thereafter, the petitioner was retired from service on super superannuation on 30.04.2024. After his retirement, he preferred an appeal before the Appellate Authority, who is the respondent herein on 01.072024 and such appeal is yet to be decided by the respondent.

3. At this juncture, the learned Special Government Pleader appearing on behalf of the respondent would submit that they would consider the appeal filed by the petitioner dated 01.07.2024 and pass order according to its own merits and in accordance with law within a reasonable time.

4. Heard the submissions of the learned counsel on either side and also perused the materials available on record.

5. In such view of the fair submission made by the learned Special 2/4

Government Pleader, without going to the merits of the writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's appeal dated 01.07.2024 and pass order according to its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. With the above observations, the writ petition stands disposed of. No costs.
