This application was filed for extension of the mandate of the Arbitrator.

2. The reasons assigned for the extension of Arbitrator is that delay caused is neither wilful nor warranted and solely because of the COVID19 pandemic and for a brief period due to the poor health of the learned sole Arbitrator.

3. Today, the learned counsel, who represents the learned Arbitrator is present before this Court and would submit that now the arbitration proceeding is at the stage of cross-examination and hence, seeks for the extension of time for a period of three months to complete the entire arbitration proceedings.

4. The learned counsel for the petitioner would also requested for the extension of time for a period of three months.

5. In spite of the notice served to the first respondent, none appeared on behalf of the first respondent, which shows that the first respondent is not interested to contest this matter.

6. Therefore, considering the submissions made by the learned counsel for the petitioner as well as the learned counsel representing the Arbitrator and also considering the facts that the arbitration proceedings had reached the stage of cross examination, this Court is inclined to extend the mandate for a further period of three months from the date of receipt of copy of this order by the Arbitrator.

7. Accordingly, this application is allowed.
