The petitioner, who apprehends arrest for the alleged offences punishable under Sections 406 and 420 IPC in Crime No.251 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.It is the case of the prosecution that the defacto complainant Magesh has given a complaint before the respondent police on the allegation that the petitioner and his wife has received a sum of Rs.17,00,000/- from the defacto complainant and thereafter failed to return the money and thereafter for the receipt of the money the defacto complainant and his wife has promised to settle his property in favour of the defacto complainant to the tune of Rs.37,00,000/-. Hence the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and a law abiding citizen and he did not commit any offences as alleged by the defacto complainant. He has no connection with the case already the co-accused in this case has been granted anticipatory bail by this Court in Crl.O.P.No.25809 of 2023. He is ready to abide by any conditions that may be imposed by this Court. Hence he prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) vehemently opposed for grant of anticipatory bail to the petitioner stating that the petitioner herein cheated the defacto complainant to the tune of Rs.37,00,000/- and no recovery has been made. The matter is under investigation. 5.Heard the learned counsel for the petitioner, and the learned Government Advocate (Crl.Side) and perused the materials available on record. 6.Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl. Side) and considering the gravity of the offence and also taking note of the fact that the case is at initial stage and it needs detailed investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 28.06.2024 ah 2/3
