The present writ petition has been filed with a prayer for Mandamus to to direct the respondents to settle and regularize the petitioner's account and release the pending service benefits along with interest, within the stipulated time.
2. The learned counsel appearing on behalf of the petitioner would submit that the petitioner was retired from service on superannuation on 30.04.2024. In the meanwhile, when he was in service, he was imposed with punishment of "Censure" on 25.04.2024. Aggrieved with the order of the punishment, the petitioner has preferred an appeal before the District Revenue Officer, who is the 2nd respondent herein vide Appeal dated 01.07.2024 and the said appeal is yet to be considered by the 2nd respondent. After retirement from service, the petitioner has sent a representation on 30.09.2024, claiming his retirement benefits and such representation is yet to be considered by the respondents.

At this juncture, the learned Special Government Pleader appearing on behalf of the respondents would submit that the 3rd respondent is the appropriate person to consider the petitioner's representation. The learned counsel would fairly submit that the concerned authority/3rd respondent would consider the petitioner's representation dated 30.09.2024 and pass order 2/5
according to its own merits and in accordance with law within a reasonable time.
4. Heard the submissions of the learned counsel on either side and also perused the materials available on record.

In such view of the fair submission made by the learned Special Government Pleader, without going to the merits of the writ petition, this Court deems it appropriate to direct the 3rd respondent to consider the petitioner's representation dated 30.09.2024 and pass order according to its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.
6. With the above observations, the writ petition stands disposed of. No costs.
