O R D E R

The present criminal original petition has been filed to direct the second respondent to register the petitioner's complaint dated 28.12.2015 and proceed with the same as per law within a time frame that may be fixed by this Court.

2. The petitioner herein lodged a complaint as against one Manoj H Metha, Harsath V Metha, Bharath N.Metha and Angeetha on the allegation of fabrication of forgery of documents and land grabbing. But, till date no action has been taken on the said complaint. Hence, the petitioner has come forward with the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondents.

The learned Additional Public Prosecutor submitted that in the earlier complaint lodged by the petitioner on 18.5.2015, the petitioner was instructed to produce the legal heir Certificate of one Kothandarama Reddiyar with correct name of the petitioner. As the petitioner has not produced the legal heir certificate, the said complaint has been closed.

5. In view of the submissions made by the learned Additional Public Prosecutor, this court directs the petitioner to give a copy of the earlier complaint, dated 18.05.2015, given to the second respondent along with the legal heir certificate with correct name of the petitioner, within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the second respondent is directed to reopen the complaint of the petitioner and conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law.

6. This criminal original petition is disposed of accordingly.
