Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to consider and pass orders on the representation dated 06.11.2014 made by the petitioner seeking to remove the name in Town Survey Patta issued in favour of the 3rd respondent from the TSLR record to an extent of 1990 sq.mtrs, pertaining to the properties said to be spread out in Survey Nos.1177/1 pt and 1176/2 pt of Korattur Village as T.S.No.62 of Block No.80, Ambattur Town and Taluk, Thiruvallur District.

By consent, this writ petition is taken up for final disposal.

2. The petitioner claims that he is a differently abled person and he is also a Senior Citizen aged about 73 years, running a painting shop in the Government lease land measuring an extent of 240 sq.ft. in S.No.320/2C of Padi Village, Ambattur Taluk, Tiruvallur District. It is further stated by the petitioner that on account of long occupation, assignment was granted by way of Regularization of Encroachments on the Government Land- Onetime Scheme in terms of G.O.(Ms).No.854, Revenue dated 30.12.2006 and would further claim that right from the date of grant of lease of https://hcservices.ecourts.gov.in/hcservices/

the said property, he is in peaceful possession and enjoyment of the same. The grievance expressed by the petitioner is that the fourth respondent, who is an allottee of adjacent land, without any right whatsoever, has managed to create documents for the purpose of getting patta not only in respect of the petitioner's property but also some of the Government lands and in this regard, he has submitted representations dated 06.11.2014, 22.03.2015 and 11.02.2016 and since no orders has been passed, came forward to file this writ petition.

3. Heard the submissions of the learned counsel appearing for the petitioner and Mr.K.Thangapandi, learned Government Advocate, who accepts notice for the respondents 1 and 2.

This Court, taking into consideration the above facts and circumstances and without going into the merits of the same, directs the first respondent to consider and dispose of the petitioner's representation dated 11.02.2016 in accordance with law, after putting on notice the respondents 3 and 4 and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner as well as to the respondents 3 and 4.
