The petitioner, who was arrested and remanded to judicial custody on 21.09.2023 in connection with Crime No.387 of 2022 registered for the alleged offences punishable under Sections 147, 148, 341, 364, 302 of IPC, seeks bail.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and is no way connected with the alleged offence, whereas, he has been falsely implicated in this case. He further submitted that the name of the petitioner does not find place even in the First Information Report and there is no previous enmity or an intention for the petitioner to murder the deceased. He also submitted that the detention order passed against the petitioner has also been revoked by this Court and the co-accused also released on bail. He also submitted that the petitioner is suffering incarceration from 21.09.2023 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to the previous enmity, the accused had joined together and murdered the de facto complainant's son by attacking him with knife. https://www.mhc.tn.gov.in/judis

4. He further submitted that there is a material evidence by way of CCTV footage to show that the petitioner, has involved in the murder. He also submitted that the petitioner is arrayed as A1 and a detailed investigation is required in this case, therefore, if he is released on bail at this stage, there is a possibility of him absconding and would threaten the witnesses and also not available for further investigation.
5. Heard the learned counsel appearing on both sides and perused the materials available on record.
6. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and taking note of the gravity of the offence committed by the accused and considering that the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
