Prayer: Criminal Original Petition filed under Section 438 Cr.P.C., praying to enlarge the petitioner on bail in the event of his arrest in Crime No.405 of 2020, pending investigation on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(aaa), 4(1-A) of TNP Act and Sections 5, 6, 7 & 11 of R.S.Rules 2000 in Crime No.405 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 24.06.2020, the petitioner was illegally found in possession of 1050 litres of I.D.Arrack, thereby, the respondent police registered a case against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that on the confession statement given by the co-accused, the petitioner has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that four similar previous cases pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
