Respondent PRAYER:- This Criminal Original Petition is filed under Section 482 Cr.P.C., to direct the respondent Police to produce the petitioner's lorry bearing Registration Number MDE 3189 and JCB Machine bearing registration number TN 25 AC 1532 before the learned District Musnif cum Judicial Magistrate, Ranipet as case properties in connection with the Crime No.1033 of 2020 pending on the file of the respondent Police.

ORDER

Seeking a direction to the respondent Police to produce the petitioner's lorry bearing Registration Number MDE 3189 and JCB Machine bearing registration number TN 25 AC 1532 before the learned District Musnif cum Judicial Magistrate, Ranipet as case properties in connection with the Crime No.1033 of 2020 pending on the file of the respondent Police, the petitioner is before this Court with this Criminal Original Petition. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3.It is seen that the petitioner is the owner of the lorry bearing Registration Number MDE 3189 and JCB Machine bearing registration number TN 25 AC 1532. The said vehicles were involved in Crime No.1033 of 2020 registered for offence under Sections 379 and 430 of I.P.C., by the respondent Police. After seizing the said vehicles, the respondent Police did not produce the same before the concerned Court.

4.The learned Additional Public Prosecutor appearing for the respondent submitted that whenever the respondent proceeded to deposit the vehicles before the Court concerned, due to lock down, the concerned learned Judicial Magistrate could not take the deposit of the vehicles.

5.Considering the above submission, the respondent is directed to produce the lorry bearing Registration Number MDE 3189 and JCB Machine bearing registration number TN 25 AC 1532 which were procured in pursuant to the crime No.1033 of 2020 registered for offence under Sections 379 and 430 I.P.C., before the learned Magistrate concerned forthwith and on such deposit, the concerned jurisdictional Magistrate is directed to issue case property number to the vehicles produced. On such deposit being made, the owner of the vehicles is directed to approach the concerned court for return of her vehicles with appropriate application.

6.With the above direction, the Criminal Original Petition is disposed of.
