O R D E R

The present Criminal Original Petition has been filed seeking a direction to the learned FTC-III Metropolitan Magistrate, Saidapet, Chennai to expedite the trial in C.C.No.11036 of 2003.

2. The petitioner has filed a private complaint under Section 138 of N.I. Act and the same was taken on file as C.C.No.11036 of 2003 and the same is pending before the III F.T.C. Metropolitan Magistrate, Saidapet. Though the petitioner side evidence was closed long back, the respondent is prolonging the matter by filing petition after petition, without examining the witnesses on his side. Hence, the petitioner has come forward with the present petition.

3. I have heard the learned counsel for the petitioner.

4. In view of the order going to be passed in this petition, there is no need for the court to issue notice to the respondent.

5. Considering the facts and circumstances of the case, this Court directs the learned FTC III Metropolitan Magistrate, Saidapet, to expedite the trial and complete the same within a period of 3 months from the date of receipt of a copy of this order.
