Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 09.03.2026 and consequently direct demolition of illegal construction made in Survey No.2/1B2 within a time frame fixed by this Hon'ble Court. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) This writ petition, styled as public interest litigation, filed under Article 226 of the Constitution of India seeks a direction to the first respondent to consider the petitioner's representation dated 9.3.2026 and to demolish the illegal construction made in Survey No.2/1B2 within a time frame fixed by this Court.
2. It is the grievance of the petitioner that, without obtaining mandatory approval from the competent authority, the fourth respondent is proceeding to construct a community hall on the playground situated in Survey No.2/1B2 of Keeranallur Village.
3. In the counter-affidavit filed by the fourth respondent, it has been stated that no construction activity has been carried on as alleged by the petitioner and any construction activity shall commence only after obtaining administrative approval from the competent authorities. For ease of reference, paragraph 14 is quoted hereunder: "14. I submit that with reference to paragraph 10 of the Writ Petition Affidavit, I submit that the representation dated 09.03.2026 submitted by the Petitioner has been received. The matter is being examined by the competent authorities. Further, as submitted above, no construction activity has been carried on as alleged by the Petitioner. Therefore, the assertion that construction is still ongoing is factually incorrect and is denied. Further, it is submitted that any construction activity shall commence only after obtaining administrative approval for construction from the competent authorities."
