Side) C O M M O N O R D E R The petitioners who apprehend arrest at the hands of the respondent police for the alleged offence under Section 366 of I.P.C. and 5(I), 5(j)(ii), 6 of POCSO Act, 2012 and Section 9 of The Child Marriage Restraint Act in Cr.No.11 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The petitioner in Crl.O.P.No.9887 of 2021/ A1 is the husband of the defacto complainant. The petitioners 1 and 2 in Crl.O.P.No.10478 of 2021/ A2 and A3 are the parents of the petitioner in Crl.O.P.No.9887 of 2021 and the petitioners 3 and 4 in Crl.O.P.No.10478 of 2021/ A4 and A5 are the parents of the defacto complainant. Since the defacto complainant is a minor and since she got conceived and gave birth to a child, the case came to be registered.

3.The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution. He further submitted that now both the defacto complainant and A1 are living happily and further submitted that since the hospital officials pressurized the defacto complainant to give complaint, she lodged the complaint.

4.The learned Government Advocate (Criminal Side) submitted that investigation reveals that A1 married the defacto complainant with her consent and that they are living together happily. 5.This Court perused the statement given by the defacto complainant under Section 164 of Cr.P.C. and it reveals that both A1 and the defacto complainant loved each other and got married without the consent of their parents and lived together separately. Thereafter, she got conceived and gave birth to a female child. Since she is a minor, the case came to be registered. Hence, this Court is inclined to grant anticipatory bail to the petitioners. 6.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Villupuram, on condition that the petitioners shall execute a bond for a sum of Rs.

(a)the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Court concerned may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b)the petitioners shall report before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter as and when required for interrogation;

(c)the petitioners shall not tamper with evidence or witness either during investigation or trial;

(d)the petitioners shall not abscond either during investigation or trial;

(e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
