ORDER

The petitioner is a retired Village Administrative Officer. He joined the above service in the year 1984. He was allowed to retire from service on 31.03.2013 on attaining the age of superannuation. According to the petitioner, though there was no disciplinary proceeding pending, the terminal benefits payable to him have not yet been settled. The grievance of the petitioner is that despite he made a representation to the respondents in this regard, there is no response. Hence, he is now before this court with this writ petition.

2. I have heard Mr.A.V.Raja, the learned counsel for the petitioner and Mr.S.Navaneehtan, the learned Additional Government Pleader, who takes notice for the respondents, and also perused the records carefully.

Considering the limited scope of the prayer sought for by the petitioner and taking into account the submissions made on either side and also the fact that the representation of the petitioner is pending, this court, without going into the merits of the claim made by the petitioner, directs the 2nd respondent to consider the representation of the petitioner dated 02.02.2015 for settlement of terminal benefits and pass orders on the same on merits and in accordance with law. It is made clear that the petitioner is also entitled for interest on the belated payment of terminal benefits in terms of the judgement of a Division Bench of this Court in GOVERNMENT OF TAMIL NADU, REPRESENTED BY THE SECRETARY TO GOVERNMENT VS. M.DEIVASIGAMANI [2009 (3) MLJ 1]. This writ petition is, accordingly disposed of. No costs.
