ORDER
The Writ Petition has been filed by the petitioner seeking a direction to the respondents to register the complaint based on the petitioner's representation dated 17.02.2026.
2.The petitioner had sent a representation on 17.02.2026 to the Commissioner of Police, which was forwarded to the second respondent. But no action has been taken.
3.The contention of the learned counsel for petitioner is that one Shanthi, entered into a tenancy lease agreement with the petitioner's father on 05.08.2022. The petitioner's father died on 29.11.2022. Thereafter with ill motive, the said Shanthi making a claim stating that she is a concupiscent of petitioner's father Late.Thiyagarajan and also filed a civil suit in O.S.No.5119 of 2025, which was in counter-blast to the petitioner's civil suit in O.S.No.6613 of 2024 filed against said Shanthi seeking to vacate and deliver the vacant possession of the petitioner's property. Since the respondent police not taken any action on the complaint of the petitioner, the present writ petition is filed. 4.The learned Government Advocate (Crl. Side) submitted that the complaint of the petitioner dated 17.02.2026 forwarded to the second respondent.
During enquiry, the said Shanthi informed that there are two civil suits filed in O.S.No.6613 of 2024 and O.S.No.5119 of 2025. Since two civil suits are pending for the property, recording the same the complaint was closed. 5.

6.The petitioner's contention merits consideration. In the Agreement of Lease, dated 05.08.2022, the said Shanthi signed as wife of Tirupathy and this Lease agreement was filed as a document in O.S.No.6613 of 2024 and Aadhaar card and Voter ID also filed in the civil suit. In view of the above, this Court finds that it is a well orchestrated crime creating forged document and using the same, right over the property has been claimed. Further the second respondent lacks expertise in investigating such offences. In view of the same, the petitioner is directed to give a fresh complaint along with supporting documents and copy of this order to the Deputy Commissioner of Police, CCB, Chennai, who shall assign the case to the competent Inspector of Police to register F.I.R. and investigate in this matter. The second respondent to forward all the papers to the Deputy Commissioner of Police, CCB, Chennai. 7.With the above observations and directions, the Writ Petition stands disposed of.
