PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent not to harass the petitioner.

This petition has been filed to direct the second respondent to not to harass the petitioner.

2. Heard the learned counsel for the petitioner and the learned counsel for the Government of Tamil Nadu (Crl.Side).

3. The learned counsel for the petitioner has submitted that the petitioner's father Late Shanmugam and the father of the complainant/Manjunathan are siblings. There was a family property and that has been inherited by the petitioner through his father and now, he is enjoying the same. There was also some partition dispute between the petitioner's father and the father of Manjunathan. Hence, the said Manjunathan filed a civil suit in O.S.No.31 of 2021 before the District Munsif, Walaja and suppressing the said fact Manjunathan had given a complaint to the first respondent and which has been forwarded the second respondent. Thereafter, the second respondent is harassing the petitioner by calling for enquiry at odd hours.

The learned counsel for the Government of Tamil Nadu (Crl.Side) submitted that one Manjunathan had lodged a complaint to the first respondent vide 561/SPG/SP/21 dated 21.05.2021 which has been forwarded to the second respondent, who had called the petitioner to appear for enquiry on the 22.05.2021, as against which, the petitioner has filed the present petition.

5. The learned counsel for the petitioner has submitted that the petitioner will appear before the second respondent and give explanation with regard to the civil dispute between his father and the father of the Manjunathan on 14.06.2021.

6. Recording the above submissions, this Criminal Original Petition is closed.
