This Criminal Original Petition has been filed to direct the second respondent police to register a case on the complaint given by the petitioner dated 01.09.2015.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.
3. It is seen that, on a complaint given by one Ambujam against this petitioner, petition enquiry is pending in CSR.No.301 of 2015. https://hcservices.ecourts.gov.in/hcservices/
On a complaint given by this petitioner, petition enquiry is pending in CSR.No.404 of 2015. On a reading of the complaint, it is seen that the dispute is with regard to title of the property, in which both the parties are claiming ownership.
4. Under such circumstances, the respondent Police cannot be directed to register an F.I.R., in a case of this nature. Hence, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in a manner known to law.
