The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 4(b) of Explosive Substances Act, 1908 in Crime No. 45 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that on 25.03.2023, on receiving the secret information, the Forest Range Officer, Madukkarai, Coimbatore along with his team conducted search, in which they found the petitioner was found in Avutu Kaai (Naatu Vedigundu) in the backyard of the petitioner's home inside a sack bag. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has got some previous cases, a false complaint has been given against him. He further submits that he has not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would submit that as per the complainant, the explosive substance was found in the backyard of the petitioner's house. He further submits that the petitioner has two previous cases, which are of similar in nature. However, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and learned Government Advocate (Crl. Side) and perused the materials available on record.

6. Taking into consideration the facts and circumstances of the case and also the submissions made on both sides and also taking note of the fact that the petitioner has two previous cases, which are of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 05.06.2023 drl
