The prayer sought for in the present petition is to set aside the order dated 03.10.2017 made in C.M.P.No.156 of 2016 in M.C.No.43 of 2016 on the file of Family Court, Dharmapuri.

2. Heard both sides and perused the materials available on records.

3. I do not find any infirmity in the impugned order passed by the Judge, Family Court, Dharmapuri dated 03.10.2017 in C.M.P.No.156 of 2016 in M.C.No.43 of 2016. The only reason for which the learned counsel for the petitioner seeks to crossexamine his second daughter is that he needs to corroborate the evidence of his another daughter who has already been examined.

4. The learned counsel for the petitioner submits that the petitioner needs to establish the attitude of the conduct of his wife through the evidence of his other daughter. Since this is the case of maintenance, I do not think that the conduct and attitude could be of much relevance, particularly on the ground that one of her daughter had already been examined. https://hcservices.ecourts.gov.in/hcservices/

5. In the result the Criminal Original Petition stands dismissed. The learned Judge, Family Court, Dharmapuri is directed to dispose of the main case in M.C.No.43 of 2016 within a period of one month from the date of receipt of a copy of this order.
