Hamsammal @ Hamsaveniammal (Died) v. Special Commissioner

Heard Mr.R.Krishnasamy, learned counsel for the proposed applicant and Mrs.R.Anitha, learned Special Government Pleader for the respondents.

The original applicant/appellant died during the pendency of the appeal. Initially, the applicant had filed application for change of cause-title and thereafter, filed the application for bringing the legal representatives on record.

It is trite that abatement has to be strictly construed and the application for setting aside the abatement has to be liberally construed.

For the reasons stated in the accompanying affidavits, both the applications are allowed and disposed of.
