ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 279, 328 of IPC r/w 7(i) and 20(ii) of Cigarette and other Tobacco Products Acts 2003, in Crime No.83 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.
3. It is seen from the submissions of the learned counsel appearing for the parties that the petitioner caused an accident while driving Mahendra Car bearing No.KA-05 MQ 8210 and caused death of a person resulting in registration of FIR in Crime No. 83 of 2022, at Nallipalayam police station. Subsequently, when the vehicle was sent for repair works, on intimation from the workshop owner, the respondent police found 480 kgs of Gudka and Tobacco products. https://hcservices.ecourts.gov.in/hcservices/
4. Considering the fact that the petitioner had involved in two offences, one causing a death of a person in a road accident and illegal possession of Gudka and Tobacco products, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this petition is dismissed.
