ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

This petition has been filed for a direction, directing the 1st Respondent to consider and pass orders of the petitioners Appeal dt. 20.03.2026 by taking into account the Letter Dt. 16.03.2026 bearing Rev.No. YPA/ Land Use/ 2026/ 101 issued by the Yanam Planning Authority, Yanam within a time frame fixed by this Court and 3rd Respondent not to act upon the letter Notification dated 12.03.2026 bearing Ref.No.1-2/A2/Estt.I(A)/ POL./2024 insofar as the petitioner is concerned.

3. It is the case of the petitioner that the petitioner is hailing from a poor family and he was selected as Sub-Inspector on 23.02.2026. The third respondent directed the petitioner to produce EWS Certificate obtained after 24.02.2026. On 26.02.2026, the petitioner applied for the certificate and the second respondent rejected the petitioner's application stating the agricultural land as the residential land. It is the grievance of the petitioner that the petitioner's family possesses agricultural land to an extent of 47.54 sq.mts, whereas, the said agricultural land is wrongly treated as residential unit, however, the Yanam Planning Authority vide letter confirmed that the said land is an agricultural land

4. It is the contention of the petitioner that the petitioner has already possesses EWS certificate for the year 2023-2024 and the petitioner's agricultural land is wrongly treated as residential house. Hence, seeks for a direction.

5. Heard both sides and perused the materials placed on record.

6. Considering the prima facie case and the balance of convenience is in favour of the petitioner, there shall be an order of interim injunction directing the third respondent not to cancel the selection process till the disposal of the appeal preferred by the petitioner before the first respondent and further, there shall also be a direction to the first respondent to consider the appeal preferred by the petitioner dated 20.03.2026 and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this Order.

7. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition stands closed. 26-03-2026 dhk
