PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the 1 to 5th respondents the relocate the transformer from the residential area to another nonresidential area based on the petitioner's representation dated 26.8.2024. For Petitioner:

ORDER

This is a petition filed by the petitioner seeking a direction to respondents 1 to 5 to consider his representation dated 26.9.2024 to relocate the transformer from the residential area to any other non residential area.

2. Heard the learned counsel for the petitioner and the learned

Standing Counsel accepting notice for respondents 1 to 4. In view of the limited nature of relief this Court proposes to grant, notice to the fifth respondent is dispensed with and the writ petition itself is taken up for final disposal.

3. The case of the petitioner is as follows:

The petitioner, along with his wife, is residing at No.2, II Cross Street, Thendral Nagar West, Thirumullaivoyal Vellanur, Thiruvallur600062. Nearby his residence, a transformer and two substations were installed. This is causing noise pollution in the locality and due to that, the families in and around could not sleep peacefully during night. Hence, the petitioner sent several representations to the respondents. The last of such representations is dated 26.9.2024 sent to the third respondent. As no action has been taken on that, the petitioner is before this Court.

4. The representation was sent to the third respondent on 26.9.2024. It is more than 11⁄2 years since the representation has been sent. The Authority concerned is the fourth respondent. It would suffice to direct the

fourth respondent to consider the said representation dated 26.9.2024 within a time frame.

5. Considering the facts and circumstances and without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the petitioner to send a copy of the representation dated 26.9.2024 to the fourth respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such a representation, the fourth respondent shall consider the same on merits and pass appropriate orders thereon in accordance with law within a period of four weeks therefrom. No costs.
