in SA.No.799 of 2023 P.T. ASHA, J., The above appeal has been preferred by the plaintiff in a suit, O.S.No.51 of 2009. The petitioner/appellant has filed the suit for partition claiming a separate possession of their 1/15th share in the suit schedule property and for an injunction. 2.

The suit was dismissed by the learned District Munsif, Pappireddipatti by the judgment and decree dated 31.08.2017, as against which, the petitioner/appellant had filed an appeal in A.S.No.26 of 2018 on the file of the Sub Court, Harur. 3.

The Appellate Court had also dismissed the appeal, by the judgment and decree dated 16.08.2022, against which, the present second appeal has been filed.

This application has been filed to stay the operation of the judgment and decree in A.S.No.26 of 2018 dated 16.08.2022 which confirms the judgment and decree of the learned District Munsif, Pappireddipatti in O.S.No.51 of 2009. 5.

This Court is at loss to understand as to what proceedings that the petitioner/appellant seeks to stay considering the fact that the suit has been dismissed.
