ORDER
The present writ petition is filed praying for a writ of mandamus, to direct the 2nd respondent to conduct a survey in the subject property viz., being vacant land measuring an extent of 66 cents, comprised in New survey No.572/1B, Elangaichery Village, Sendurai Panchayat Union, Ariyalur District based on the application of the petitioner dated 21.11.2023 and submit the survey report.
2. It is submitted by the learned counsel for the petitioner that the petitioner had filed an online application on 21.11.2023 to conduct survey and has also paid necessary charges but the 2nd respondent has not yet surveyed the property. Hence, this writ petition.
3. At the outset it is submitted by the learned Special Government Pleader 2/5
appearing for the respondents that they would consider the online application dated 21.11.2023 and carry out a survey and submit a survey report within a time frame fixed by this Court, which was agreed to by the learned counsel for the petitioner.
4. In view thereof, the writ petition stands disposed of with the direction to the respondents to consider the online application dated 21.11.2023 and carry out a survey and submit a survey report within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice to the petitioner and other interested parties/stake holders. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs.
