O R D E R

The petitioner has filed this petition to direct the third respondent to implement the order of the first respondent in petition No.10/2018/Pea, dated 23.07.2018 and complete the approach road.

2. Learned counsel for the petitioner submitted that petitioner resides at Koderi Post, The Nilgiris, and seeks the completion of an approach road originally sanctioned in 2009-2010 for a length of 900 meters at an estimated cost of Rs.18 lakhs, from the residence of P.B.Bheeman to the petitioner's residence. While 280 meters were laid by villagers at their own cost and 500 meters by the third respondent, the remaining 120 meters were left incomplete due to objections from certain landowners. However, the said landowners have since given their no objection, as confirmed through RTI replies. Despite the first respondent passing an order on 23.07.2018 in Petition No.10/2018/Pea directing the third respondent to complete the remaining portion, no steps have been taken so far. come forward with the present writ petition.

3. Learned Special Government Pleader appearing for the third respondent submitted that this Court may direct the petitioner to give representation to the third respondent for implementing the order of the first respondent dated 23.07.2018, within a time frame to be fixed by this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In view of the above submission made by the learned counsel on either side, this Court without going into the merits of the case issues the following directions:

(i) The petitioner is directed to give a representation to the third respondent, within a period of three weeks from the date of receipt of a copy of this order.

(ii) On such receipt, the third respondent is directed consider the said representation, after giving due notice to the petitioner, affording an Page No.3 of 6

opportunity of personal hearing and considering the documents filed by the petitioner on merits, in accordance with law and pass appropriate orders, within a period of eight weeks thereof.

6. This writ petition is disposed of with the aforesaid observation and directions. No costs.
