CMP No.6852 of 2016 has been filed by the petitioners / proposed respondents 3 to 5 seeking to condone the delay of 340 days in filing the petition to set-aside the abatement caused due to the death of the first respondent deceased P.Balasubramaniam in the above Appeal.

2. CMP No.6853 of 2016 has been filed by the petitioners / proposed respondents 3 to 5 to set-aside the abatement caused due to the death of the first respondent deceased P.Balasubramaniam in the above Appeal.

3. Heard the learned counsel for the petitioners / proposed respondents 3 to 5.

Having regard to the reasons stated in the accompanying affidavits filed in support of these petitions and being satisfied with the same, these petitions, seeking to condone the delay of 340 days in filing the petition and to setaside the abatement caused due to the death of the first respondent deceased P.Balasubramaniam, in the above Appeal, are ordered as prayed for.

5. These petitions are ordered accordingly.
