...RESPONDENTS Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus, directing the 2nd respondent herein, namely, the Regional Transport Officer (South), Coimbatore, not to process the application and grant appointment to the 4th respondent herein, namely, J.Christopher on compassionate grounds till the learned I Additional District Munsif, Coimbatore adjudicate the suit in O.S.No.2666 of 2013.

After hearing sometime, when this Court inclined to dismiss the Writ Petition, the learned Counsel for the petitioner has fairly submitted that the petitioner would be permitted to pursue his remedy before the civil forum i.e. in O.S.No.2666 of 2013 on the file of the learned I Additional District Munsif, Coimbatore and accordingly, the learned Counsel for the petitioner has also made an endorsement withdrawing the Writ Petition.

Recording the same, the Writ Petition is dismissed as withdrawn with liberty to the petitioner to pursue his remedy in a civil court to agitate for his rights, if so advised. No costs.
