O R D E R
This writ petition has been filed seeking a direction to the third respondent to provide police protection for her life and for the construction of a compound wall in Plots Nos.5 and 7, in S.F.No.82/2 part, Ranjith Nagar Layout, Sholinganallur Taluk, measuring a total extent of 7600 sq.ft. by considering her representation dated 09.03.2025.
2. The case of the prosecution is that the petitioner purchased two adjoining plots in Sholinganallur using her own funds, registering one (Plot No.7) in her husband's name, who is the fourth respondent herein, as a name-lender. Despite a divorce and a mutual agreement for him to transfer the plot to her, the fourth respondent fraudulently executed a settlement deed in 2018 in favour of the fifth respondent, claiming her as
his wife, while the marriage with the petitioner was still subsisting. While being so, on 07.02.2025 and 06.03.2025, the fourth and fifth respondents trespassed into the property with unknown persons, damaged the property, and attempted to take unlawful possession. Despite police complaint, no action has been taken. Hence, this petition.
3. Heard both sides and perused the materials placed on record.
4. Considering the facts and circumstances of the case, this Court is of the view that police protection can only be granted to safeguard a person's life and limb. In the event of any obstruction or objection while constructing the compound wall around the petitioner's property, the petitioner is at liberty to approach the Civil Court for appropriate relief.
5. In view of the above, this writ petition stands dismissed. No costs.
