Learned counsel for the appellant represents that this second appeal has become infructuous in view of the subsequent arbitration proceedings held with reference to the issues involved between the parties and also represented that the respondent had challenged the arbitral award passed before this Court in O.P.No.257 of 2014.
2.The counsel for the appellant has also made an endorsement to that effect in the grounds of appeal. In the light of the
above position, the second appeal is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition, if any, is closed.
