Respondents in W.P.No.4644 of 2010 PRAYER in W.P.No.4643 of 2010: Writ Petition has been filed under Article 226 of the Constitution of India for the issuance of Writ of Certiorarified Mandamus, to call for the records of the demand by sending the notice of demand signed on 27.10.2009 and handed over to the petitioner on 17.02.2010 on the file of the 2nd respondent persisting the demand made in HQR/No.25/07-08 dated 23.05.2007 and to quash the same and further direct the
respondent to consider the representation dated 08.09.2007 and the further representation dated 07.11.2007 handed over to the 2nd respondent on 20.11.2007.
PRAYER in W.P.No.4644 of 2010: Writ Petition has been filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, to forbear the respondents or any other officers subordinate to the respondents from giving effect to the demand made by the respondent through the demand letter dated 04.01.2010 brought to the notice of the relating bill No.34/23, 34/24, 34/26, 34/27, 34/30 on the file of the 2nd respondent reminded by the petitioner on 06.01.2010. For Petitioner in both W.Ps. : Mr.K.Loganathan For Respondents in both W.Ps.: Mr.T.C.Gopalakrishnan C O M M O N O R D E R Mr.K.Loganathan, learned counsel appearing for the writ petitioner fairly made a submission that the writ petitioner would clear the entire arrears of property tax dues of Rs.5,40,438/- within a period of four (4) weeks from the date of receipt of a copy of this order.
2. In view of the undertaking given by the learned counsel appearing for the writ petitioner, no further adjudication needs to be entertained in respect of the grounds raised in the writ petition. Accordingly, the Writ Petitions stand disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
3. It is made clear that in the event of failure on the part of the writ petitioner in paying the arrears of property tax dues within the time stipulated above, the Corporation of Chennai, is directed to initiate all further action by following the procedures contemplated under law within a period of four(4) weeks thereafter.
