...Respondents

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 1st respondent to consider the petitioner's representation dated 26.03.2019 and release the Lease Deed in P.Doc.No.1 of 2019, on the file of the 1st and 2nd respondents after completion of registration.

For Petitioner : Mr.L.Chandrakumar For Respondents: Mr.P.P.Purushothaman, Government Advocate

O R D E R

The petitioner seeks for a Mandamus directing the first respondent to consider the representation dated 26.03.2019 and release the lease deed in pending Document No.1/2019 on the file of the 2nd respondent after completion of registration.

2. Heard both sides.

3. It is seen that the petitioner presented a lease deed dated 11.01.2019 for registration before the 2nd respondent, who in turn, assigned pending Document No.1/2019 and kept it pending without passing any further order thereafter. Therefore, the https://hcservices.ecourts.gov.in/hcservices/

petitioner approached the 1st respondent and gave a representation on 26.03.2019 seeking for registration of the said document and returned the same. It is stated that the first respondent has not passed any order so far.

4. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the first respondent to look into the grievance of the petitioner and pass appropriate orders, after getting a report from the second respondent. Thus, this Writ Petition is disposed of by directing the first respondent to consider the representation of the petitioner dated 26.03.2019 and pass orders on the same on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The first respondent, after getting a report from the second respondent, shall inform the petitioner to make their objection, if any, on the report furnished by the second respondent and consider the objections so filed by the petitioner and thereafter pass orders accordingly. No costs.
