ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No. 136 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The prosecution of the case is that the petitioner was found in possession of 1.100 kg of Ganja. Hence, the complaint. 1/4

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in this case. It was further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that 1.100 kg of ganja was recovered from the petitioner. It was further submitted that, after such recovery, the petitioner absconded from the scene of occurrence. He contended that, in an NDPS case, grant of anticipatory bail would have an adverse impact on society. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the totality of the circumstances and also taking into account the severity of the allegation against the petitioner, this Court is of the view of that the petitioner does not deserve anticipatory bail. 2/4
