Defendants PRAYER: Civil Suit filed under Order VII Rule 1 & 2 of Code of Civil Procedure and Order IV Rule 1 of Original Side Rules, praying for a judgment and decree against the defendants :- 1/5
(a) declaring that the settlement deed executed by the 1st defendant in favour of the 2nd defendant under Document No.3033 of 2016 on the file of Sub Registrar, Thyagaraya Nagar dated 27.12.2016 is null and void and not binding on the plaintiff; (b)permanent injunction restraining the defendants or their agents or their men or anyone claiming under them from in any manner interfering to demolishing the Suit 'A' schedule property hereunder;
(c) directing the division of the suit property into two equal shares and allotting the one share to the plaintiff and putting the same in their separate possession;
(d)appointing an advocate commissioner to effect division in the aforesaid manner (e) directing the defendants to pay the cost of the suit to the plaintiff. The learned counsel for the plaintiff has filed a Memorandum of Compromise dated 20.11.2023. The terms of compromise read over to the parties by translating it in Tamil and the parties understood and stated that they have affixed their signatures after understanding the terms. The said Compromise Memo is recorded.

Hence this Civil Suit is decreed in terms of Compromise Memo entered into between the plaintiff and the defendants 1 to 3. The Compromise Memo shall form part of the decree. The refund of Court Fee is ordered in accordance with law. No costs. Consequently, O.A.No.344 of 2023 is closed.
