Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the third respondent to remove the encroachment made by the 4th and 5th respondents in Government Road Survey No.37/1 in Survey No.37/36.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.V.Balamurugan, learned counsel for the petitioner; Mrs.R.Anitha, learned Special Government Pleader for respondents 1 to 3 and Mr.P.Karunanithi, learned counsel for respondents 4 and 5.

2. Learned Special Government Pleader submits that survey has been made. An encroachment has been identified and the same would be removed in accordance with law.

3. In case some action is initiated, it will be open for respondents 4 and 5 to raise all possible defences available to them.

4. The writ petition is disposed of. There will be no order as to costs.
