Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus to direct the respondents 2 and 3 to provide Agricultural Electricity Service Connection under any one of the schemes referred above in Para No.3 to the bore-well comprised in Survey No.446/2D, Samandankottai West Pulliyangadu Garden, Vanjipalayam Post, Mangalam, Tirupur District, belongs to the petitioner at the earliest.

By way of filing this writ petition, the petitioner seeks a direction to the respondents 2 and 3 to provide Agricultural Electricity Service Connection under any one of the schemes to the bore-well comprised in Survey No.446/2D, Samandankottai West Pulliyangadu Garden, Vanjipalayam Post, Mangalam, Tirupur District, belonging to the petitioner.

2. Heard the learned counsel appearing on either side.

The petitioner, who is aged about 72 years, is the owner of the agricultural lands comprised in survey Nos.446/2D, 447/2C, 447/2J and 458/3A1, to an extent of 1.050 hectares, situated at Samandankottai West, Pulliyangadu Garden, Mangalam, Tiruppur District. It is stated that as the pumping of water from the bore-well is the only source for irrigation, he made an application dated 27.07.2005 to the authorities seeking 7.5 HP agricultural electricity connection under self-finance scheme for his bore-well situated at S.No.446/2D, however, the application was returned with some defects and thereafter, after rectification, though the petitioner made an another fresh application dated 19.10.2010 to the respondents seeking the above said relief, the same was not considered by the respondents till date.

4. Mr.S.K.Raameshwar, learned standing counsel for the respondents, by accepting notice, sought reasonable time to consider the petitioner's application, subject to seniority and merit.

5. In view of the above, this Court, without going into the merits of the matter, directs the respondents 2 and 3 to consider the pending application dated 19.10.2010 of the petitioner on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. With this direction, the writ petition is disposed of. No Costs. WMP.No.1390 of 2017 is closed.
