JUDGMENT

Mr.P.Muthukrishnan, learned counsel appearing for the appellant submits that the issue raised in this appeal has been settled out of Court between the parties, as the appeal itself is filed against the order of acquittal of the trial Court in a case filed under Section 138 of the Negotiable Instruments Act. 2.The learned counsel appearing for the appellant has also filed a Memo on behalf of the appellant dated 12.02.2018, which is extracted hereunder:

MEMO FILED ON BEHALF OF THE APPELLANT 1)It is respectfully submitted that the above Criminal Appeal has been preferred on behalf of the Appellant as against an order of acquittal.

2)It is respectfully submitted that the matter had been settled out of Court and therefore, the Appellant herein has requested to withdraw the above Appeal.

In view of the said submission made by the learned counsel appearing for the appellant and by taking on record the Memo filed by the appellant and also, the endorsement he has made in the Court bundle to that effect, this Criminal Appeal is dismissed as withdrawn.
