J U D G M E N T

H.M.O.P.No.413 of 2021 filed by the husband for divorce on the ground of cruelty and desertion was dismissed by the Family Court after full trial. Challenging the dismissal of his petition, the husband has preferred the present appeal.

2. Pending appeal, the parties have entered into settlement and have decided to dissolve their marriage by mutual consent. Accordingly, joint compromise memo dated 07.11.2025 and Settlement Agreement dated 22.10.2025 are filed before this Court.

3. Both the appellant and the respondent are present before this Court today and are identified by their counsel. They have stated that they have consented to dissolve the marriage by mutual consent and pursuant to the terms of the agreement, the appellant (husband) has given Rs.10.00 lakhs to the respondent, the receipt of which has been duly acknowledged.

4. In view of the above fact, this Court recording the joint compromise memo dated 07.11.2025 and settlement agreement dated 22.10.2025, dissolve the marriage solemnized between the appellant and the

respondent on 29.11.2017. The joint compromise memo dated 07.11.2025 and settlement agreement dated 22.10.2025 shall form part of the decree.

5. This Civil Miscellaneous Appeal stands disposed. No costs.
