T.Sekar, S/o.Late Tulukkanam ..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the second respondent to consider and pass orders on the petitioner's representation dated 02.12.2024 seeking for the deletion of the land comprised in S.No.265/1A1 having an extent of 1.00 Acres in Patta No.230, Vedal Village issued in the name of fifth respondent and to issue patta in petitioner's name under the provisions of Tamil Nadu Patta Pass Book Act.

ORDER

This writ petition has been filed seeking for a direction to the second respondent to delete the name of the fifth respondent in the patta for the property morefully disclosed in the affidavit filed in support of this writ petition based on the petitioner's representation dated 02.12.2024 within a time frame to be fixed by this Court. The petitioner also seeks for issuance of patta in his name for the very same property.

2. The petitioner claims that patta has been erroneously issued in the name of the fifth respondent for the property morefully disclosed in the affidavit filed in support of this writ petition. The petitioner also claims that before the civil Court, the fifth respondent was unsuccessful in proving his title over the property morefully disclosed in the affidavit filed in support of this writ petition.

3. According to the petitioner, he is the owner of the property morefully disclosed in the affidavit filed in support of this writ petition and he is in possession of the same and therefore, patta for the said property has to be issued

in his name. The petitioner had given a representation on 02.12.2024 to the second respondent for the aforesaid purpose. Since no final orders have been passed by the second respondent till date, the petitioner has filed this writ petition.

4. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4. Since no adverse orders are passed against the fifth respondent in this writ petition, notice to the fifth respondent is dispensed with by this Court.

5. No prejudice would be caused to the respondents if a direction is issued to the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 02.12.2024 seeking for deletion of the name of the fifth respondent in the patta for the property morefully disclosed in the affidavit filed in support of this writ petition and for issuance of patta in the name of the petitioner for the said property after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of the fifth respondent and any other third party whom the second respondent deems fit to enquire within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioner's representation.

7. For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 02.12.2024 seeking for deletion of the name of the fifth respondent in the patta for the property morefully disclosed in the affidavit filed in support of this writ petition after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of the fifth respondent and any other third party whom the second respondent deems fit to enquire within a period of twelve (12) weeks from the date of receipt of a copy of this order.
