ORDER

(This case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379, 430 of IPC and r/w 21(5) of MM ACT r/w 3 of P.P.D.L Act in Crime No.93 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 19.02.2020 when the respondent police was on usual patrol duty they found that the petitioner was trying to transport the three units of sands illegally through lorry. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit that there were two previous cases pending against the petitioner. Hence, he vehemently opposed for grant of Anticipatory bail to the petitioner.

5.Taking into consideration of the facts and circumstances of the case and there were two previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
